BANKING AND FINANCE
Our attorneys represent numerous financial institutions, lenders, borrowers and developers for their borrowing, financing and lending needs. This includes traditional construction, acquisition, development, mezzanine, hard money and business lending and creative financing (with municipalities, bonding districts, facilities districts and investment capital). In such capacity we have:
• Prepared the first Communities Facilities District in the Town of Buckeye
• Represented underwriters and borrowers in connection with negotiating, offering and closing loan and offering documents for industrial revenue and pollution central bonds
• Successfully completed a multi-project loan workout on behalf of one of our national lender clients
• Represented private lenders, such as a Canadian group funding several million dollars to a small U.S. public company
• Negotiated multiple loan modifications and forbearance agreements on behalf of numerous lenders and borrowers
• Acted as trustee and conducted trustee’s sales for residential and commercial properties
• Represented a lender in documenting and refinancing a loan secured by an Arizona assisted living facility
• Assisted not-for-profit entities, such as churches and health-care facilities, in raising capital under appropriate exemptions
• Represented receivers with respect to the preservation and disposition of special assets
• Represented a lender in documenting and refinancing a loan secured by an Arizona assisted living facility
• Completed a multi-party note and loan purchase for distressed assets on behalf of an international condominium developer
• Represented issuers of syndicated, privately-placed debt with initial trustees representing note holders
• Represented hard-money lenders in syndicating loan funds
